1. Agreement to Terms
By accessing and using Omnipeak's services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
2. Services Provided
Omnipeak provides specialized legal services in corporate restructure, regulatory compliance, and cross-border trade matters in Malaysia. All services are subject to the laws of Malaysia and professional legal standards.
3. Scope of Engagement
Engagement with Omnipeak is formalized through a separate engagement letter. These terms apply to all communications and consultations unless expressly modified in writing.
4. Client Responsibilities
- Provide accurate, complete, and timely information
- Maintain confidentiality of advice received
- Comply with all applicable laws and regulations
- Pay fees as outlined in the engagement letter
5. Fees and Payment
Fees are as quoted or agreed upon in the engagement letter. Payment is due upon invoice unless alternative arrangements are made. Late payments may incur interest at 1.5% per month.
6. Limitation of Liability
Omnipeak's total liability for any claim arising from these services shall not exceed the total fees paid in the preceding 12 months. Omnipeak is not liable for indirect, consequential, or punitive damages.
7. Confidentiality & Attorney-Client Privilege
All communications between client and Omnipeak are subject to attorney-client privilege and shall remain confidential, except as required by law or court order.
8. Data Protection
Personal data is processed in accordance with applicable data protection laws, including GDPR principles where applicable. Data is used solely for service delivery and will not be shared with third parties without consent, except as required by law.
9. Termination
Either party may terminate the engagement with written notice. Upon termination, outstanding fees remain due, and work product becomes the property of Omnipeak until payment is received.
10. Disputes
Any disputes arising from these terms shall be governed by Malaysian law and resolved through arbitration or the courts of Kuala Lumpur.
